What is Chancery Court?

Chancery Courts have exclusive original jurisdiction over most cases of an equitable nature and generally handle cases that are beyond the jurisdiction of other courts. Chancery Courts share jurisdiction over certain types of civil cases with other courts.

Chancery Courts share jurisdiction with Circuit Courts over most civil cases. Chancery Courts do not handle cases with certain kinds of unliquidated damages, but a Chancery Court may hear most civil cases if no objection is raised.

Circuit Courts may hear cases of an equitable nature if no objection is raised, and Circuit Courts will have the powers of a Chancery Court if an equity case is heard in Circuit Court.

Chancery Courts share jurisdiction with Circuit Courts over divorce, adoption, arbitration, the release and appointment of trustees, trustee petitions or probate proceedings for the sale of property, partition and distribution of real or personal property, paternity, name changes, and the abatement of nuisances. Chancery Courts have some jurisdiction over the appointment of administrators to a decedent's estate under certain circumstances. In some counties, Chancery Courts have jurisdiction over the probate of wills, administration of estates, and all aspects of guardianships and conservatorships.

Chancery Courts have exclusive jurisdiction over cases filed by the State against corporations, certain types of requests by creditors, and cases involving disputes over the boundaries of land.

 

What is a Clerk and Master?

The Clerk and Master for Perry County is Charlene Duplessis, and was appointed to her office by the Division Judges of the 21st District.  As such she is charged with all the clerical and administrative duties conferred upon all elected clerks of courts in Tennessee and is further authorized by statutes, by the Local Rules of Practice and by Court Order to serve as a Master in Chancery for the 21st Judicial District in Perry County, Tennessee, otherwise known as the Clerk and Master.

As the Clerk and Master, Charlene is required to discharge and perform the duties of her office diligently, honestly, impartially, courteously and efficiently.

The Clerk and Master  is also clerk of the Probate Division of the Chancery Court, and employs deputy clerks to assist the office in opening new cases, maintaining the Court files and records, setting the docket and providing support to the Chancellors during hearings on matters brought before the Court.

In addition to the administrative duties in the Chancery Division, the Clerk and Master in Perry County also serves as a judicial officer for the Probate Division and oversees the probate of wills and administration of decedents’ estates.  Ms. Duplessis administers all estates except in solemn form, appoints personal representatives for estates, claims against estates, appoints guardian ad litems for minors, guardianship and conservatorship cases, approves annual accountings, and various other duties of estate administration.

Chancery and Probate Courts

The Clerk & Master, as Clerk of the Chancery Court, is required by statute to:  keep rule and execution dockets, enter minutes of the court, file and enter all documents, pleadings, papers and exhibits, invest funds under the Clerk’s control, attend court, legal custodian of court records, administer oaths, issue all summons, writs, executions, subpoenas, and attachments, prepare court record on appeals, collect revenue for the county and state, and perform all other duties as required by law.   In Probate Court, the Clerk & Master administers all estates except in solemn form, appoints personal representatives for estates, claims against estates, appoints guardian ad litems for minors, guardianship and conservatorship cases, approves annual accountings, and various other duties of estate administration.  The Local Rules of Practice for Tennessee Courts, including the 21st Judicial District, may be found at TNcourts.gov.
